Public Hearing Regarding Cannabis In May

Please be advised that a Public Hearing will be held in Council Chambers located in Suite 102 – 103 Second Street East, Revelstoke, B.C. on Tuesday, May 22, 2018 at 3:00 p.m. for the following bylaw(s):

Zoning Amendment Bylaw No. 2224

The purpose of the Bylaw is to amend the City of Revelstoke Zoning Bylaw No. 1264, 1984, on not allowing any cannabis and related uses including cultivation within the City’s jurisdiction.

In anticipation of the Federal Government’s adoption of Bill C-45 to legalize non-medical cannabis, which is expected to come into effect this summer, City staff has made recommendations to Council on amending the current Zoning Bylaw. They include:

  • adding definitions of “cannabis”, “cannabis dispensary”, “cannabis production facility”, and excluding the growing of cannabis from the definition of “horticulture”;
  •  prohibiting all cannabis and related uses from all districts, zones, or any other lands currently not zoned within the City’s jurisdiction

The intent of this zoning amendment is to prohibit cannabis and related uses within the City’s jurisdiction until after Provincial regulations are in place and staff are able to develop a municipal regulatory program. This interim cannabis use prohibition is necessary to ensure that staff have time to conduct public consultations, prepare policies, regulations and procedures for Council to consider and adopt at a future date.

Inspection of Documents: Copies of the bylaw(s) and related documents will be available for review in the Engineering and Development Services Department at City Hall, 216 Mackenzie Avenue, on the following 2018 weekday dates: May 9, 10, 11, 14, 15, 16, 17 and 18 between the hours of 8:30 a.m. and 4:30 p.m., and on May 22, between the hours of 8:30 a.m. and 3:00 p.m.

Public Participation: At the hearing, the public shall be allowed to make representations to Council respecting matters contained in the proposed bylaw(s). Local Government Act Section 465 (2) Public Hearings states that “At the public hearing, all persons who believe that their interest in property is affected by the proposed bylaw must be afforded a reasonable opportunity to be heard or to present written submissions respecting matters contained in the bylaw that is the subject of the hearing.”

Written submissions can be submitted to the Corporate Officer until the close of the Public Hearing. All persons who prefer to have their submissions available to Council members in advance as part of the Public Hearing agenda package, should deliver their submissions to the Administration Department, 216 Mackenzie Ave., P.O. Box 170, Revelstoke, B.C. V0E 2S0 (Fax #: 250-837-4930 or admin@revelstoke.ca) before 12:00 noon on Tuesday, May 22, 2018. No further submissions can be considered by Council after the conclusion of the Public Hearing.
